This End User License Agreement ("EULA") governs your use of the WallHunt desktop application ("the Software") distributed by Top Rated LLC ("WallHunt"). By installing or using the Software, you agree to this EULA. If you do not agree, do not install or use the Software.
1. License Grant
WallHunt grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on personal devices you own or control, solely for the purpose of displaying live wallpapers on your desktop. This license is contingent on your continued compliance with this EULA and the WallHunt Terms of Service.
2. Permitted Use
- Install the Software on any number of personal Windows machines
- Display free wallpapers and any paid wallpapers tied to your WallHunt account entitlements
- Customize display settings (resolution, multi-monitor layout, performance throttling, playback controls)
- Report crashes and issues to WallHunt
3. Restrictions
You may not:
- Reverse engineer, decompile, or disassemble the Software, except to the extent expressly permitted by applicable law
- Circumvent, disable, or otherwise interfere with any authentication, entitlement, or DRM mechanism
- Redistribute, sublicense, rent, lease, or sell the Software or any paid wallpaper files
- Extract or export decrypted wallpaper content from the Software's runtime
- Use the Software for any unlawful purpose or in violation of the Terms of Service
- Remove or alter any proprietary notices, labels, or marks on or in the Software
4. Ownership & Entitlements
The Software is licensed, not sold. All intellectual property rights in the Software remain with WallHunt and its licensors.
Access to paid wallpapers is governed by entitlements managed by Stripe. WallHunt maintains a local cache of your active entitlements for offline display, but Stripe is the source of truth. If your WallHunt account is terminated, or an entitlement is refunded or revoked, your access to the corresponding wallpapers will be removed on the next entitlement sync.
5. Auto-Updates
The Software may automatically check for, download, and install updates to ensure security, stability, and compatibility. Updates may include bug fixes, performance improvements, new features, and security patches. You consent to receive these updates as a condition of using the Software. You may disable auto-update in Settings, but doing so may prevent you from accessing new wallpapers or receiving security fixes.
6. Telemetry
The Software collects anonymous crash reports and performance metrics to help us diagnose issues and improve the product. This data includes system information (OS version, GPU model, available memory), performance measurements (FPS, frame time), and stack traces on crashes. It does not include personal information or the contents of your files. You may disable telemetry in Settings → Privacy → Telemetry.
7. Third-Party Components
The Software bundles open-source components subject to their own licenses, including but not limited to: Silk.NET (MIT), WPF-UI (MIT), .NET 8 runtime (MIT), and Direct3D shader samples (various licenses). A complete list and the full text of each license is available in the LICENSES.txt file bundled with the Software and in the About dialog.
8. Termination
This EULA is effective until terminated. It will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and delete all copies in your possession. Sections 3 (Restrictions), 4 (Ownership), 9 (Disclaimer), and 10 (Governing Law) survive termination.
9. Disclaimer & Limitation of Liability
The Software is provided "AS IS" without warranties of any kind. WallHunt disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. WallHunt is not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Software.
10. Governing Law
This EULA is governed by the laws of the State of Indiana, United States, without regard to conflict of laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Marion County, Indiana.
